This agreement is entered into by and between Nicky Pennie, Be Your Best Yet Empowerment Coaching (“The Coach”), and you (The Client”).

Both Parties Agree to the Following

Description of Coaching
Coaching is a collaborative ongoing relationship between the coach and client, in a thought provoking and creative process that inspires the client to maximise personal and professional potential.  It is designed to empower the client to make changes in their mindset that will enable them to achieve the goals in their personal or professional life that were previously out of reach. These could include (but are not limited to) personal foundation, career development, relationship enhancement, spiritual growth, mid-life assessment, healthy lifestyle management, life balance, decision-making, and achieving short-term or long-term goals.

Coach-Client Relationship

The Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.   

The Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.  

The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in whichever coaching program they have purchased.


The parties agree to engage in a Coaching Package delivered via online video meetings using Zoom or other platforms as agreed between the Coach and Client.

Schedule and Fees

Fees are as published on the Coach’s website, www.beyourbestyet.co.uk in relation to the coaching session or programme chosen.

Fees are payable before the start of the coaching session or programme.

Individual coaching calls/meetings shall be for up-to 60 or 90 minutes depending on the package chosen (refer to www.beyourbestyet.co.uk for up-to-date information).

Refund Policy

Any unused coaching sessions will not be refunded but may be held for the client to book their coaching sessions within a reasonable time, at the discretion of the coach.

The time of the coaching meetings and/or location will be determined by Coach and Client based on a mutually agreed upon time.

Coaching sessions can be booked at convenient times using the online Acuity calendar which is available via the Coach’s website at www.beyourbestyet.co.uk.  The Client may request meetings at other times subject to agreement with and availability of the Coach.

Rescheduling of appointments can be made by Client or Coach up to 24 hours before the original appointment time.

Coaching is a confidential relationship and the coach agrees to keep all information strictly confidential, except in those situations where such confidentiality would violate the law.

The Coach will not disclose the Client’s name as a reference without the Client’s consent.

The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

Limited Liability
Except as expressly provided in this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date.

Dispute Resolution
If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 after notice given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover solicitor’s fees and court costs from the other party.

Applicable Law
This Agreement shall be governed by the laws of England and shall be subject to the exclusive jurisdiction of the English courts.

1 to 1 coaching programmes

The client commits to schedule & attend coaching sessions fortnightly, to ensure the consistency of the coaching relationship & have the highest likelihood of success. Coaching sessions less frequent than fortnightly must be approved by The Coach. It is The Client’s responsibility to ensure that the sessions are booked in as per the of the specific coaching package.

Group Coaching Programmes

Inside group coaching programmes The Client commits to follow the programme outline, including completing modules & exercises, in a timely manner. The Client commits to work through the syllabus in the order that the programme is designed & assumes responsibility for ensuring that they complete a module before starting the next one.

The Client commits to attend calls live where possible & to notify the Coach where they’re unable to do so.

The Coach commits to respond to posts & questions inside the group coaching programme community in office hours (9am – 5pm) within 24 hours, except for weekends & public holidays.

The Client commits to adhere to the rules inside the community & not to attempt to coach others inside the container.

The Client is fully aware that they have access to the materials inside the programme for the duration that they’re in the programme. When the timeframe for the programme is complete (typically 16 weeks) they will cease to have access to the programme materials. It is therefore the responsibility of The Client to ensure they manage their time inside the container to get the most from the programme. If The Client requires support with completing the modules & associated exercises, they should contact the Coach for support in good time to be coaching on how best to achieve this.

The Client commits to stay engaged in the programme, to be coachable & implement what they’re learning. If The Client struggles with any aspect of the programme, they commit to contact the Coach by email at nicky@beyourbestyet.co.uk for ­­­support.

Voice note/message support

For coaching packages that benefit from voice note & message support, The Coach commits to respond to messages in office hours (9am – 5pm) within 24 hours, except for weekends & public holidays.

This support exists to support The Client to navigate aspects of their lives between coaching sessions.


For all coaching, the more committed The Client is to their progress & the more that they’re prepared to commit to the work, the greater the likelihood of achieving the desired outcome.
